Product Warranty

Maximicer warrants that the Maximicer Water Chilling System when properly installed, used, and maintained by Customer, will be free from defects in materials and workmanship for a period of five (5) years from the date of purchase.

Maximicer’s obligation under this limited warranty shall be limited to the repair or replacement of the water chilling system at Maximicer’s option, provided that Customer gives Maximicer prompt notice of any defect or failure and satisfactory proof thereof. Any defective recovery system must be returned to Maximicer’s factory or such other destination as shall be designated by Maximicer. Customer is responsible for all shipping costs of returning the recovery system to Maximicer and Maximicer will be responsible for shipping the new or repaired recovered system back to the Customer. This warranty is limited to use of the water chilling system on commercial ice machines and cold-plate drink dispensers and does not apply to nonperformance of the water chilling system caused by its misuse, mishandling or misapplication.

If the water chilling system is altered or repaired by Customer without prior written approval of Maximicer, all warranties are void. A new warranty period will not be established for a repaired or replaced water chilling system. Such a system shall remain under warranty only for the remainder of the warranty period on the original system.

The foregoing warranties are in lieu of all other warranties, whether oral, written, express, implied, or statutory. Implied warranties of fitness and salability shall not apply. Maximicer’s warranty obligation and Customer’s remedies are solely and exclusively as stated herein. In no case will Maximicer be liable for any incidental, consequential, or special damages or any other loss resulting from the failure of a water chilling system or of any of its component parts.

With respect to water chilling systems purchased by consumers in the United States for personal use, the implied warranties, including but not limited to the warranties of salability and fitness for a particular purpose, are limited to twelve (12) months from the date of delivery.

Some states do not allow limitations on the duration of an implied warranty or the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusi
